Definitions
Service Provider
SimpleChef, address<TBD>, tax number<TBD>, etc., which operates the website and provides the Services.
User
Any natural or legal person who uses the website and services provided by the Service Provider, including recipe generation and uploading recipes.
Recipes
The recipes created and published by the User on the website, as well as those generated and published by the Service Provider's website. The Recipes may include descriptions, ingredients, and preparation instructions for food, beverages, or other types of kitchen products.
User Content
All content, information, data, or other materials that the User shares through the website, including Recipes and related comments and opinions.
Expert
A person or company who provides expert advice and opinions in the relevant field, such as a nutrition expert, dietitian, doctor, or other professional.
Subject of the Contract
The purpose of this contract is to define and regulate the terms and conditions related to the services provided by the Service Provider, with particular regard to the creation, publication, and use of Recipes, and the allocation of responsibilities.
User Responsibility for Recipes and User Content
Responsibility for Recipes and User Content
The User accepts and undertakes full responsibility for all Recipes and other User Content created by them. The User guarantees that the Recipes and other User Content do not violate any applicable laws, third-party intellectual property rights, personal rights, or any other legitimate interests.
Use of User Content
The User expressly grants the Service Provider the right to use, modify, reproduce, publish, and distribute the User Content on the website and in connection with it. However, the Service Provider assumes no responsibility for the User Content and reserves the right to remove or modify it at any time if it violates the provisions of this Agreement or other regulations, or if deemed necessary based on other legal requirements or third-party notifications.
Prohibited Content
The User declares and guarantees not to share or create User Content that is offensive, obscene, threatening, defamatory, discriminatory, or in any way unlawful.
Recipes Displayed by the Service Provider
Display of Recipes
The Service Provider's website also provides a function that allows for recipe creation or display. These recipes are for informational purposes only, and Users may use them solely at their own risk.
Accuracy and Suitability
The Service Provider assumes no responsibility for the accuracy, correctness, completeness, or suitability of the generated Recipes for any purpose. The Service Provider does not guarantee that the Recipes will always meet individual needs, nutritional requirements, or health conditions. Users are responsible for the proper interpretation and application of the Recipes, and it is recommended that they consult with an expert before using the Recipes for appropriate purposes.
Necessity of Consultation with Experts
Consultation with Experts
The User agrees that before creating and using the Recipes, they will always consult with an appropriate expert, especially, but not exclusively, if the individual has health problems, food allergies, or other dietary needs. The Service Provider expressly advises Users to seek out the appropriate expert before making any health or dietary decisions and to follow the health advice and instructions provided by professionals.
Professional Advice
The Service Provider explicitly states that it does not provide medical, dietetic, or any other professional advice, and in no way does it substitute for the advice or opinions of experts. The information found on the website does not constitute medical or dietetic advice, and it is the User's responsibility to use them in accordance with their own health condition, needs, and requirements. The User must clearly understand that the information on the website is for informational purposes only and does not replace medical or professional consultation.
Service Terms, Denial of Service, User Deletion, and Restriction
It is prohibited to include links to other websites in the recipe.
The Operator has the right to delete from its system without any prior notice or notification, any data, information, or recipes that violate public morality or legislation, the legitimate interests of others, or do not fit the structure of the website, as well as misleading, false, or otherwise inappropriate content, including hidden advertisements.
It is prohibited to upload content to the Website that:
- violates the law or promotes illegal activities
- commits a crime or misdemeanor
- is contrary to morality or violates applicable ethical norms
- encourages or incites illegal or immoral behavior
- infringes upon or may infringe upon the rights or legitimate interests of others, especially if it violates trademark protection, intellectual property rights, or other copyright and neighboring rights, or personal rights
- contains misleading information
- The Operator considers to be contradictory to its ethical principles
- or raises suspicion of the above
The Operator is entitled to refuse to provide the Service and exclude the User from accessing the services available on the website (by deleting the User's account or advertisement) if, in the Operator's judgment, the User does not use the Website as intended or improperly uses the services provided by the Operator, especially if:
- the User intends to carry out activities that require official authorization without being entitled to do so through the site
- the User uses the Website/Webpages or the Service in a manner that contradicts the provisions of this Terms of Service, violates the law, or is unfair
- the User posts content on the Website or refers to content in a way that violates or may violate the rights, reputation, business interests, or general perception of the Operator (or its group of companies), especially regarding the assessment of its products or services
- the User uses the Website or the Service in a way that violates or may violate the rights or legitimate interests of third parties
- the User uses any application or program that can modify the Website or otherwise endanger the proper operation of the Service
- the User uses a system or solution that aims to enable, facilitate, or result in the illegal use of the Service or the shutdown of the servers used for the operation of the Website
- or raises suspicion of the above
The Operator reserves the right to deny repeated registration from the IP address of the User affected by the denial of Service as defined in this Terms of Service, or to delete any existing repeated registration without prior notice and with immediate effect. The Operator shall notify the Trader User of this decision by email at least 30 days in advance, but is not obliged to justify this decision.
In case of repeated violations, the Operator may restrict the use of the services for the User concerned. In such cases, the User shall not be entitled to any compensation or refund, but shall be obligated to compensate the Operator for any damages incurred in connection with it.
Data Privacy and User Content
Handling Confidential Information
The Service Provider and the User commit to treat all business and sensitive information provided by the other party in a confidential manner. The handling of personal data provided by the User during the use of the website will be in accordance with the applicable data protection regulations. The Service Provider will handle the User's personal data and User Content as specified in the Privacy Policy.
Use of User Content
The User declares and agrees that the Service Provider may use the User Content for advertising, marketing, or other business purposes, provided that the User expressly consents to it.
Termination of the Agreement
This Agreement shall terminate when the User ceases to use the Service or when the Service Provider decides to terminate the service. The termination of the Agreement does not affect rights and obligations that have already arisen.
Jurisdiction and Dispute Resolution
Jurisdiction
The laws of the country where the Service Provider is headquartered shall apply to this Agreement.
Dispute Resolution
Any disputes that may arise shall be resolved through mutual good faith negotiations between the parties. If the dispute cannot be resolved amicably, the parties agree to the exclusive jurisdiction of the courts at the headquarters of the Service Provider.
Other Provisions
In matters not regulated by this Agreement, the applicable laws shall apply.
